These Terms and Conditions are effective from 11th May 2024 between users of the Pay 4 Stay App and the Pay 4 Stay Website and Off-Street Parking Ltd.

From here on, the Pay 4 Stay website will be referred to as “the website”, and the Pay 4 Stay App shall be referred to as “the app”.

By downloading, accessing, or using the Pay 4 Stay application ("the App") or visiting the Pay 4 Stay website ("the Website"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the App or the Website. These terms and conditions shall be binding whether the user is accessing Pay 4 Stay via a registered account or as a guest user on the app or the website.

Pay 4 Stay Service Offering

The App and The Website are provided for the purpose of facilitating the payment of parking tariffs at designated parking locations or car parks without the need to use cash. The payments need to be made using the available payment methods listed within the app and on the website. You agree to use the App and the Website only for lawful purposes and in accordance with all applicable laws and regulations in England & Wales.

The availability of Pay 4 Stay is dependent on your access to the internet. Pay 4 Stay and Off-Street Parking shall not be held responsible for any drop in internet service that prevents you from accessing our services. If there is no alternative way to pay at the parking location, then you as the user are responsible for adhering to the parking terms and conditions enforced at the location. Please ensure that you observe signs displaying the terms and conditions of the location you are at. Pay 4 Stay and Off-Street Parking shall not be held liable for parking charges and parking tickets that are issued to you as a result of not paying, overstaying, or contravening any term or condition at the location where you park your vehicle.

At locations where Off-Street Parking is not the Car Park Operator, the tariffs on Pay 4 Stay may differ from the tariff displayed at the location itself. You must pay the tariff for your desired length of stay on Pay 4 Stay if you choose to pay using the app or the website. Pay 4 Stay and Off-Street Parking shall not be held accountable for any discrepancies or parking charges and tickets that may arise as a result of your underpaying.

Guest Users

Guest Users are able to use Pay 4 Stay without the need to register an account. Some features are unavailable to guest users. Guest users are bound by these terms and conditions through the use of the services available on the app and the website. Guest users must ensure they input their vehicle registration fully and accurately to avoid charges or parking tickets.

Account Registration

Users who register an account with Pay 4 Stay are required to provide true and accurate information in order to use the website or the app. Users with a registered account may store their vehicle details and other information, so they are able to experience a more streamlined experience when they visit the website or use the app. Account Holders must ensure that they input their vehicle registration fully and accurately to avoid charges or parking tickets

Payment and Payment Processing

When you initiate a payment transaction through the App or Website, you authorise Pay 4 Stay to process the payment on your behalf. Payment processing may be facilitated through third-party payment processors, and you agree to abide by their terms and conditions.

Pay 4 Stay and Off-Street Parking are not responsible for any charges you receive from your bank, or any data charges related to the use of mobile phone data.

The payment methods are detailed on the app and the website. If you are not able to make payment using the methods available, then you may be required to park your vehicle at a different location if no other payment facility is available to you.

Please note that it is not possible to pre-pay for your parking session as the parking session will begin as soon as the payment is made. Pay 4 Stay and Off-Street Parking Ltd shall not be held accountable for refunding payments made in advance of a vehicle being present at the parking location.

Refunds

Refunds and cancellations of parking transactions are subject to the policies of the respective Parking Operators for the location the transaction was related to. Pay 4 Stay and Off-Street Parking do not guarantee refunds or cancellations and are not liable for any disputes arising from such transactions.

You are responsible for selecting the length of your stay at the beginning of your parking session when you make payment to Pay 4 Stay. Pay 4 Stay and Off-Street Parking shall not be made accountable for any refunds should your length of stay turn out to be shorter than your paid parking session.

Pay 4 Stay and Off-Street Parking shall only consider refunds where the disputed money has been taken due to a system issue or a technical glitch that resulted in you paying for a service that was not required.

Parking Charges, Penalties, and Parking Tickets

You are solely responsible for adhering to all traffic laws and parking terms and conditions for the location where your vehicle is parked. Pay 4 Stay and Off-Street Parking shall not contribute to payments or assist with any appeals that are required for a penalty, a charge, or a ticket.

Parking Session Details

You are responsible for providing the correct vehicle registration and length of stay when paying for your stay on the app or the website. By providing your registration, you agree that Pay 4 Stay is permitted to share this with third-party car park operators and management companies for the location where your vehicle is parked. Additionally, your paid parking session details and parking expiry time shall be shared with these third parties to assist with parking management and enforcement activities.

Legal Requirements

You agree that you will act and behave in a manner that complies with the laws governing England & Wales.

Whilst using Pay 4 Stay you agree to only use payment methods that are registered to you or that you have authorisation to use from the named account holders.

You agree not to commit an offence under the Computer Misuse Act 1990.

Limitation of Liability

Pay 4 Stay and Off-Street parking are not liable for any damages, losses, or expenses incurred as a result of your use of the App or the Website, including but not limited to, loss of data, loss of revenue, or interruption of business operations. In no event shall Pay 4 Stay or Off-Street Parking be liable for any indirect, incidental, consequential, or punitive damages.

Indemnification

You agree to indemnify and hold harmless Pay 4 Stay, Off-Street Parking, their affiliates, officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, or expenses arising out of your use of the App or the Website or any violation of these Terms and Conditions.

Modification to the Terms and Conditions

Pay 4 Stay and Off-Street Parking reserve the right to modify or amend these Terms and Conditions at any time without prior notice. Your continued use of the App or the Website following any changes constitutes acceptance of the revised terms.
